กลับมาจากการประชุม National Conference on Nanotechnology & Regulatory issues 2009 ที่จัดโดย The Energy and Resource Institute และ University of Calcutta, India โดยผู้เขียนได้นำเสนองานAwareness raising strategies for construction industry: A case of Bangkok construction industry on nanomaterials
ไปเมื่อวันที่ 9 มกราคม เลยขอเล่าสู่กันฟังในบางประเด็น งานนี้มีวัตถุประสงค์เพื่อนำเสนอกรอบกฎหมายที่เกี่ยวข้องกับการพัฒนาด้านนาโนเทคโนโลยีในอินเดียและ
ข้อสรุปจาก round table consulting meeting คือนำเสนอให้รัฐบาลอินเดียใช้มาตราการทางกฎหมาย ที่มีอยู่เดิมในด้านสิ่งแวดล้อมและข้อชดเชยต่อการเสียหายที่เกิดกับบุคคลและสาธารณะโดยเพิ่มเติมด้าน ประเด็นในเรื่องการใช้นาโนเทคโนโลยีในผลิตภัณฑ์ต่างในท้องตลาด เพื่อลดข้อพิพาทอันเกิดจากการใช้ เทคโนโลยีดังกล่าวในอนาคตซึ่งโดยภาพรวมอินเดียได้มีอุตสาหกรรมต้นน้ำด้านนาโนเทคโนโลยีได้แก่
โรงงานผลิต ท่อนาโนคาร์บอนในมุมไบ 3-4 แห่งในขณะที่ความรู้ด้านสาธารณะเกี่ยวกับประโยชน์และ โทษของการใช้นาโนเทคโนโลยียังไม่ชัดเจนนัก(เหมือนๆกับหลายประเทศ)ผู้เข้าร่วมประชุมส่วนมากเป็น นักวิชาการทางด้านกฎหมาย แพทย์ นักวิทยาศาสตร์และNGO งานที่นำเสนอแบ่งเป็น 3 ประเด็น
หลัีกได้แก่ กฎหมายระหว่างประเทศและในประเทศด้านนาโนเทคโนโลยี การควบคุมความเสี่ยง
(ผู้เขียนได้นำเสนอในหัวข้อนี้)และประเด็นเร่งด่วนซึ่งได้มีการเปรียบเทียบเทคโนโลยีนาโนคล้ายกับการ พัฒนาเทคโนโลยีด้านGMOsซึ่งผู้เชี่ยวชาญจากอังกฤษให้ความเห็นว่านับเป็นเรื่องที่น่ายินดีที่อย่างน้อย ได้มีการริิเริ่มที่จะพูดเรื่องนี้ในแวดวงกฎหมายเพราะเทคโนโลยีดังกล่าวมีผลกระทบต่อสังคมโดยตรงผู้เขียน ก็หวังว่าเมื่อไหร่รัฐบาลไทยจะเริ่มตื่นตัวเหมือนกับประเทศเพื่อนบ้านของเราบ้างเพราะถ้าเกิดกรณีปัญหาขึ้น แต่ไม่ระบุในข้อบังคับหรือกฎหมายก็คงยากที่จะหาผู้รับผิดชอบหรือแม้แต่ถ้ามีกฎหมายออกมาภายหลัง จากที่สาธารณะเคยชินกับวิถีปฏิบัตินั้นๆก็อาจจะไม่สามารถบังคับหรือเปลี่ยนพฤติกรรมของคนได้โดยง่าย เราคงต้องรีบทบทวนเรื่องนี้ก่อนจะกลายเป็นคอกอีกอันที่วัวหายไปแล้ว


I came back from National Conference on Nanotechnology & Regulatory issues 2009 that was hosted by The Energy and Resource Institute and University of Calcutta, India. I have an opportunity to present a topic Awareness raising strategies for construction industry: A case of Bangkok construction industry on nanomaterials on January 9. So I would like to share that this conference aim to promote a draft of regulation on nanotechnology application in India. A conclusion remark from round table consulting meeting is Indian government could use the existing regulation like Environment Act and amendment on nanotechnology issue that will help to mitigate future conflicts. Holestic view, India already have some upstream nanotechnology industry in Mumbi while public knowledge on benefit and risk of nanotechnology still unclear (as same as other countries). Most delegate who attended this conference came from School of law, medical doctors, scientists and NGOs representative. Conference theme is cover the international and national regulations, risk regualtion and cross cutting issues. They compared nanotechology development similare to the track of GMOs technology however a delegate from UK mentioned that it is a good opportunity to discuss this impacts on society in the context of law formation. As an author, I also hope Thai government will start to raise this issue up as well as our neighboring country otherwise when the problem become exist, it is hard to be negotiate without regulation support. Even regulation will become very hard to enforce when public already get familiar with wrong practice as I hope it will not be too late to shut the stable-door when the steed is stolen.
